You see pictures everywhere that are copyrighted, it doesn't mean people can't edit them etc.

Also, I just want to point out to everyone that this is almost definately fake. Regardless of it being april 1st, the design is incredibly poor on those covers. Nintendo would never use that font and it would never give out box art that grainy. I'm sorry.
